JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 302/34 of the Indian Penal Code.

As per the prosecution case, this petitioner and other accused persons committed murder of the sister of the informant.

Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased and he had no intention to kill her. In fact some altercation took place on the question of children and petitioner tried to pacify the same. Meanwhile, deceased assaulted the petitioner with a broom. Thereafter, in the heat of passion, petitioner hit her with spade as a result of which she died while being taken to

Patna High Court CR. MISC. No.69152 of 2021(3) dt.26-04-2022 2/2 hospital. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 10.7.2021.

Learned counsel for the State opposes the prayer for bail.

Considering the nature of accusation against the petitioner, his prayer for bail is refused.
