JUSTICE RAKESH KUMAR ORAL ORDER 21-09-2017 After some argument, Sri Arvind Kumar, learned counsel for the petitioners, in presence of learned Addl. Public Prosecutor, requests for allowing him to withdraw the prayer for anticipatory bail of petitioner no.2, namely, Kamlesh Mandal @ Kamlesh Kumar Mandal and petitioner no.3, namely, Anil Mandal, who are also accused in earlier case relating to Excise Act.
The prayer is allowed.
Accordingly, the petition for grant of anticipatory bail in respect of petitioner nos.2 and 3 stands rejected. So far as petitioner no.1, namely, Domini Devi is concerned, learned counsel for the petitioners submits that this
Patna High Court Cr.Misc. No.45192 of 2017(2) dt.21-09-2017 2/2 petitioner has been made accused since her husband, Anil Mandal was involved in the case relating to recovery of 6.5 liters of Nepali liquor. It has been indicated that the petitioner no.1 is having clean antecedent.
Considering the nature of accusation as well as the fact that the petitioner is a lady having clean antecedent, let the petitioner no.1, namely, Domini Devi, in the event of her arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Ghogardiha P.S. Case No.72/2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure (Rakesh Kumar, J) nawalkrs/- U T
