====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-11-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, on 06.02.2025 at about 2 PM, quarrel took place between these petitioners and wife of the informant which was pacified by the informant and thereafter, informant along with his wife went to Bahiyar. It is alleged that at about 5:30 PM, when informant and his wife returned to their
Patna High Court CR. MISC. No.57543 of 2025(3) dt.04-11-2025 2/3 house, they found their daughter hanging dead with Saree around her neck. Informant suspects that these petitioners committed murder of his daughter.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Petitioners are gotiyas of the informant and there is admitted land dispute between the parties. Informant is not an eye witness of the alleged occurrence and petitioners have been made accused in this case merely on suspicion. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P. S. Case No. 176 of 2025, subject to condition as laid down under Section 482(2)
