JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Pirbahore P.S. case No. 321 of 2017 registered for the offence punishable under sections 147, 149, 302 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the alleged occurrence took place on account of parking of Scooty by the tenant of one Lallu Yadav in which some hot altercation took place and the son of the informant fell down on earth and resultantly died. Petitioner has been falsely implicated in this case merely because he is the brother of the daughter-inlaw of Lallu Yadav. In the post mortem report no external or internal injury was found. Moreover, similarly situated coaccused has been granted bail by this Court vide order dated 07.11.2017 passed in Cr. Misc. No. 52740 of 2017.
