Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, on the alleged date and time of occurrence husband of the informant left his residence for office but he did not return leading to registration of FIR against unknown.
Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has surfaced in this case during the course of investigation in the confessional statement of co-accused, Golu Kumar, which has got no evidentiary value and save and except confessional statement of co-accused no tangible material has been collected
Patna High Court CR. MISC. No.69052 of 2021(6) dt.17-05-2022 2/2 during the course of investigation against this petitioner to show is complicity in the aforesaid crime. Petitioner claims clean antecedent and is in custody since 18.08.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Patna in connection with Kankarbagh PS case No. 65/2021.
