ANSHUMAN ORAL ORDER 05-12-2022 Learned counsel for the petitioner submits that due to inadvertence, the wrong case number has been typed in the prayer portion of the petition. Learned counsel seeks permission to correct the same.

Permission is hereby granted.

Petitioner may correct the same in course of the day. Let the defect, if any, be removed within two weeks from today.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Uda Kishunganj P.S. Case No. 174 of 2021 lodged under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

As per the prosecution case, total recovery of 119.100

Patna High Court CR. MISC. No.57051 of 2022(2) dt.05-12-2022 2/2 liter of mahua wine has been made, which is subject matter of the present case.

Learned counsel for the petitioner submits that the alleged recovery has been made from a motorcycle of the petitioner and petitioner is said to be owner of the said motorcycle and he is in custody since 18.08.2022 having clean antecedent.

Learned A.P.P. for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-Vth-cum-Special Judge Excise Act, Madhepura in connection with Uda Kishunganj P.S. Case No. 174 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
