JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Sangrampur P.S. Case no. 12 of 2017, registered under Sections 379 and 411 of the Indian Penal Code and Section 4/40 of B.M.M.C. Rule. The accusation is that on receiving secret information about illegal mining of sand and loading the same in the tractor. The informant along with other Police personnel proceeded for Aliganj Musahari Govindpur road and saw that a tractor bearing Reg. No. BR4439 attached with trailer was coming loaded with illegal sand. On seeing the Police, the driver of the tractor fled away leaving the tractor and trailer.
Learned counsel for the petitioner submits that, in fact, the petitioner is the owner of the seized vehicle and he has no knowledge about indulging of his vehicle in carrying of illegal sand.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Sangrampur P.S. Case No. 12 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
