JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to the first information report, the marriage of the petitioner had taken place with deceased six years ago and after marriage, deceased gave birth to two children. The informant claimed that deceased and petitioner were leading happy married life but petitioner and his family members used to demand Rs. 5 lacs to start a business and when the aforesaid demand was not fulfilled, they used to torture the deceased and subsequently, they committed murder of the deceased and disposed of her dead body.

In his written report, the informant has stated that his

No.45206 of 2015 (3) dt.04-02-2016 2/2 wife got information about the illness of deceased from one Manoj Singh of village Narsama on mobile phone on 5.11.2014 and after that informant went to the house of the petitioner to see his daughter and saw that the accused persons were returning after cremation of dead body of his daughter.

The contention on behalf of the petitioner is that in course of investigation, almost all the witnesses have stated that deceased died of her illness and except the informant, none has supported the prosecution story.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S.Case No. 251 of 2014.
