JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Karpi P.S. Case No. 115 of 2017, registered under Section 7 of the Essential Commodities Act.

The accusation is that five fair price shops including the fair price shop of the petitioner was checked by the Block Supply Officer. In that course, some beneficiaries disclosed that they had received 1 K.G. less grains to the fair price shop of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to ulterior motive and he has no criminal antecedent.

Patna High Court Cr.Misc. No.42344 of 2017 (2) dt.19-09-2017 Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Arwal, in connection with Karpi P.S. Case No. 115 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
