The petitioner apprehend his arrest in connection with Jagdishpur P.S. Case no.352 of 2022, registered for the offence punishable under Sections 20/21 of N.D.P.S. Act of the Indian Penal Code.
The allegation against the petitioner is that he alongwith other co-accused persons are involved in the selling and purchasing of contraband articles.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. He further submits that no incriminating articles has been recovered from the
Patna High Court CR. MISC. No.56777 of 2022(3) dt.16-01-2023 2/2 physical conscious possession of the petitioner. The name of the petitioner transpired in the present case only on the basis of confessional statement of apprehended co-accused namely, Tunna Mishra. Petitioner has one criminal antecedent of similar nature.
Learned APP for the State opposed the prayer for anticipatory bail by submitting that the petitioner is a member of syndicate involved in the selling and purchasing of contraband articles.
Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. Accordingly, this bail application shall stand dismissed. (Anjani Kumar Sharan, J) shikha/- U T
