2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323 , 379, 308 , 504 and 34 of IPC .

3 . As per F.I.R. petitioner No. 1 assaulted on the head of informant with axe and petitioner No. 2 assaulted on Daleshwar das with knife , upon his cheek , as a result of which, they sustained injuries.

4. Learned counsel for the petitioners contended that allegation of assault is general and omnibus against these petitioners. Injury sustained by informant is simple in nature .

5 . Learned counsel for the State opposed the bail and submitted that injury caused by petitioner No. 2 is grievous in nature .

6. Considering the nature of accusation against petitioner No. 2, the prayer for pre - arrest bail of petitioner No. 2 is rejected.

7. Considering the fact that allegation of assault is general and omnibus against petitioner No. 1 , clean antecedent and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner No. 1 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned JMFC Jamui in connection with Chandramandih P.S. Case No. 200 of 2023 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
