Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek bail in a case instituted under Sections 201, 304(B) and 34 of the Indian Penal Code. The petitioners along with other F.I.R. named accused persons are said to have been involved in the commission of murder of the sister of the informant.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 07.09.2016. The charge sheet has been submitted in the present case. The petitioners have got
Patna High Court Cr.Misc. No.53122 of 2016 (2) dt.08-12-2016 2/2 no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. They are not named in the F.I.R. The petitioners are the agnates of the husband of the deceased. They are separate in mess and property from the husband of the deceased.
On behalf of the state, it has been submitted that the petitioners are not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Pankaj Kumar, J.M.1st Class, Begusarai, in connection with Bachhwara P.S. Case No. 83 of 2016.
