JUSTICE SANJAY PRIYA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and the State. Earlier prayer for anticipatory bail was rejected by this court by order dated 21-03-2017 passed in Cr. Misc. No. 29-09-2016. Learned counsel for the petitioner has submitted that he is renewing his prayer on the fresh ground of alibi. It is submitted that the petitioner was on duty till 6.00 p.m. on 01-07-2016. This court has already given liberty to the petitioner in the earlier order for surrender in the court below and seek regular bail, which shall be considered on its own merit without being prejudiced by that order.
Therefore, this court is not inclined to reconsider the prayer for anticipatory bail of the petitioner. Accordingly, it is rejected. The petitioner is directed to surrender in the court below and
Patna High Court Cr.Misc. No.35289 of 2017 (2) dt.02-08-2017 make prayer for regular bail and, will take all the points in the court below which has been raised in course of hearing of this petition and the court below will consider those points in accordance with law and dispose of the same without being prejudiced by this order.
