Having regard to the nature of allegation against the petitioner for offence under Section 302/34 of the Indian Penal Code, this Court, taking into account that the petitioner has also been named by the co-accused Uday Yadav in his confessional statement which has also been further corroborated in the statement of an independent witness namely Raju Bhagat at para20 of the case diary and that the co-accused has been granted only regular bail, this Court would not find the petitioner entitled for privilege for anticipatory bail.
That being so, the prayer for anticipatory bail of the petitioner is hereby rejected.
Nothing said in this order, however, will come in the way of the petitioner in surrendering and making prayer for
Patna High Court Cr.Misc. No.51256 of 2014 (4) dt.16-07-2015 2/2 regular bail and if he does so, the prayer for regular bail shall be considered on its merit without being influenced by this order. (Mihir Kumar Jha, J) Sujit/- U
