JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-08-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending his arrest in connection with Turkauliya P.S. Case No. 830 of 2015 registered for the offences punishable under Sections 341, 323, 504, 506 and 436 of the Indian Penal Code, seeks the privilege of pre-arrest bail. Allegedly, the informant did not give the articles on credit to the petitioner resulting he abused caused threats to the informant. The wife of the petitioner assaulted with lathi. However, on the intervention of villagers, the informant was saved but the petitioner caused threat to burn the shop and in the night the petitioner put the shop on fire and thereafter fled away. Submission is of false implication and that no offence as alleged is made out. The prosecution story appears not to be true

Patna High Court Cr.Misc. No.35397 of 2017 (2) dt.11-08-2017 2/2 and as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, considering the nature of allegation against the petitioner, I am not inclined to grant pre-arrest bail to the petitioner and his such prayer stands rejected.
