The petitioner apprehends his arrest in connection with Barsoi P.S. Case No. 109 of 2017, registered for the offences punishable under Sections 147, 341, 323, 307, 379, 504, 506 of the Indian Penal Code.
The learned counsel for the petitioner submits that there is case and counter case, there was free fight between the parties, both sides have received injuries but now the matter has been compromised and compromise petition has been filed vide Annexure-5. Against the petitioner there is allegation to have assaulted with wooden piece, causing injury on the hands and body of the informant. There was no intention to commit murder
Patna High Court Cr.Misc. No.35340 of 2017 (2) dt.11-08-2017 2/2 and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that now the matter has been compromised.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar, in connection with Barsoi P.S. Case No. 109 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
