JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-08-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner apprehends his arrest in connection with Dumriaghat P.S. Case No. 143 of 2016 registered for the offences punishable under Sections 414, 420, 406/34 of the Indian Penal Code.

Allegedly, four persons were apprehended by the informant and Police personnel and they disclosed the name of the petitioner as the driver of Santro Car from which bundles of papers were recovered and they disclosed that they are indulged in note doubling.

Submission is of false implication and that the petitioner has not been apprehended on the spot, nothing has been recovered from his possession, due to enmity the petitioner has

Patna High Court Cr.Misc. No.35461 of 2017 (2) dt.11-08-2017 been named by the apprehended accused persons. The petitioner is not the driver of the said car and as such he deserves sympathetic consideration.

Learned APP fairly submits that the name of the petitioner was taken by apprehended accused persons. In the facts and circumstances stated above, the petitioner above named, in the event of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Motihari in connection with Dumariaghat P.S. Case No. 143 of 2016, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
