JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Bakhtiharpur P.S. Case No.155 of 2015, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. The petitioner is in custody since 16.06.2015 and he is said to have no criminal antecedent. Referring to the First Information Report, learned counsel, appearing on behalf of the petitioner, has submitted that there is no allegation of specific overt act against the petitioner and the only allegation against him is that he was the member of the mob.

The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiarpur P.S. Case No.155 of 2015, corresponding to G.R. No.1050 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
