JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 08-01-2018 This appeal under Clause 10 of the Letters Patent seeks exception to an order dated 07.09.2016 passed in Civil Review No. 405 of 2014 after CWJC No. 18039 of 2013 was decided by the learned Single Bench on 08.07.2014. The Superintendent of Police (Vigilance) filed an application for review and 07.09.2016 and in the review application finding material warranting consideration the order passed on 08.07.2014 in CWJC No. 18039 of 2013 was recalled. The said writ petition is pending consideration now
Patna High Court LPA No.2155 of 2016 dt.08-01-2018 2/2 before appropriate Writ Court and in this appeal challenge is made to the order of recall.
Taking note of the totality of the circumstances, the prayer for recall of the order passed in the review application the present LPA is not maintainable and on merit also we see no reason to make any indulgence into the matter.
The appeal stands dismissed.
