The petitioner Nikesh Kumar seeks bail in Ghosi P.S. Case No. 8 of 2014, registered for the offences punishable under Sections 406, 420 and 506 of the Indian Penal Code. Allegation against the petitioner is that he took Rs. 1 Lakh from the informant on the pretext of giving him partnership in a firm of licensee liquor shop. It is alleged that the petitioner prepared a non-judicial stamp to return the money, but the same was not returned.

Learned counsel for the petitioner submits that the dispute is of civil nature. It is pointed out that the petitioner has got criminal antecedents.

Having considered the facts aforesaid and nature of allegation made against the petitioner and the fact that the dispute

No.879 of 2015 (2) dt.09-01-2015 arose out of borrowing and lending money, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, in connection with Ghosi P.S.
