Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks on resumption of physical mode. The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and 25(1-b) A/26/35 of the Arms Act.

The prosecution case is that on information that some armed miscreants were assembled near industrial area campus planning for committing some crimes, the police party reached there, on seeing the police party miscreants started running

Patna High Court CR. MISC. No.69054 of 2021(2) dt.07-06-2022 2/3 away. However, the police party apprehended one miscreant namely Ajit Kumar Jha @ Sonu Jha. On the confessional statement of said Ajit Kumar Jha @ Sonu Jha, the name of this petitioner transpired as one of the miscreants. Learned counsel for the petitioner submits that name of the petitioner sprang upon the confessional statement of coaccused and nothing specific has been alleged against him nor any recovery has been made from his possession. The petitioner is also accused in four other criminal case out of which two cases are of similar nature of offence.

Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Samastipur in connection with Musarigharari P.S. Case No. 144 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further conditions :-

1. The petitioner is directed to remain physically
