JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

The petitioner was Secretary of the School.

Allegation is that in collusion with the Headmaster of the School the money meant for completion of the building work has been misappropriated and the construction work has not been completed within the time framed.

Submission of the petitioner is that Annexure-2 reveals that construction work is complete now. The headmaster Mr. Gangadhar Mishra has already been allowed anticipatory bail

Patna High Court Cr.Misc. No.51024 of 2016 (2) dt.19-12-2016 2/2 by a Co-ordinate Bench of this Court in Cr. Misc. No. 23308 of 2016 on 28.07.2016.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Araria/Successor Court in connection with Bhargama Police Station Case No. 212 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
