2. The petitioners are apprehending arrest in connection with Brrahampur (Krishnabraham) P.S. Case No. 206/2023, lodged on 18.04.2023, for offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution story, F.I.R has been lodged against three named accused persons including the present petitioners with an allegation that they have fired gun shot upon the informant's son due to which he died.

4. Learned counsel for the petitioners submits that

No.66948 of 2024(2) dt.11-09-2024 2/2 after investigation, the police had not found involvement of the petitioners in the present case and submitted the final form which is annexed as Annexure-2, but differing with the final form, the Trial Court has taken cognizance against all the accused persons. He further submits that petitioners have got clean antecedents.

5. Learned APP for the State opposes the prayer for bail.

6. As such, considering the aforesaid facts and circumstances, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs. 30,000/- (Thirty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, subject to the condition as laid down under Section 438(2) Cr.P.C.
