The petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 03.06.2021, charge-sheet has been submitted in the case and has antecedent of six cases. The informant alleges that he was intercepted by three accused persons who snatched his bag but on alarm being raised, one accused was caught while two fled but the villagers caught one accused with arms and the looted bag further it is alleged that one more accused was apprehended i.e., the petitioner and from him five live cartridges were recovered and

Learned counsel for the petitioner submits that the coaccused Rakesh Rai who has been granted bail vide order dated 05.05.2022 passed in Cr. Misc. No. 60715 of 2021 also had four antecedents. It is further submitted that as far as this petitioner is concerned, against him it is alleged that from his possession five live cartridges were recovered and he came to be implicated by the police based on his antecedents and further submits that cartridge without a gun is useless.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 03.06.2021, charge-sheet has been submitted in the case and the co-accused has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sahpur Patori (Mohanpur O.P.) P.S. Case No. 138 of 2021 with a condition that one of the bailors of the petitioner shall be his father, Suresh Bhagat.
Further, if the learned court below comes to a
