17-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, in the present, case, is seeking Anticipatory Bail in connection with Govindganj P.S. Case No. 305/2016 for the offences under Sections 419/420/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner was not arrested on the spot. There is no allegation that this petitioner had committed any act in attempt to cheat the informant. His name has transpired in the confessional statement of the co-accused. The petitioner has no criminal history, and so far police has not been able to collect any material implicating this petitioner in the present case. He is also ready to cooperate in course of
Patna High Court Cr.Misc. No.43860 of 2017 (3) dt.17-10-2017 investigation.
Learned Additional Public Prosecutor for the State submits that from the impugned order and the materials collected by the police the allegations against three accused persons who were arrested on spot have been found true but investigation against this petitioner is still pending and presently there is no material against him. Considering the facts and circumstances of the case, in the event of his arrest/surrender before the court below within a period of four weeks, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -1, Motihari at East Champaran, in connection with Govindganj P.S. Case No. 305/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that petitioner will cooperate during course of investigation with police and shall present himself for interrogation as and when required by the Investigating Officer.
