JUSTICE SUDHIR SINGH ORAL ORDER 24-02-2016 Heard learned counsels for the petitioner, informant and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Town P.S. Case No. 341 of 2015 for the offences instituted under Sections 420, 467, 468, 471 and 120(B)/34 of the IPC. The prosecution story, in brief, is that the informant was informed by Raju Jha broker of the land that his 03 Kathas of land has been sold by his Gotia to Rama Shankar Singh and Shavitri Devi. On this information, the informant went to Registry Office and got the sale deed. Later on, Raju Jha came to him and asked to sell the same land then the informant became ready to sell on a consideration money of Rs. 42,00,000/-. Raju Jha came with purchasers and gave cash of Rs. 11,00,000/- and assured to pay the rest amount. Thereafter, Raju Jha took L.T.I. of the informant on
Patna High Court Cr.Misc. No.52423 of 2015 (3) dt.24-02-2016 2/2 different papers. Later on, the informant came to know that registration of his land was already done without payment of dues amount. The informant found the forged signature on the document.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The matter relates to sale and purchase of the land between the parties. The dispute is of civil nature. The petitioner claims himself to be only a broker. On behalf of the learned counsels for the informant and the State it has been submitted that the petitioner is named in the F.I.R. Till date, no civil suit has been filed in respect to dispute in question.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Town P.S. Case No. 341/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
