JUSTICE SANJAY PRIYA ORAL ORDER 31-08-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Laheri P.S. Case No. 118 of 2017 instituted for the offence under Sections 406, 409, 420, 467 and 468 of the Indian Penal Code. Supplementary affidavit has been filed on behalf of the petitioner. Let it be kept on the record. It is alleged that the informant opened his account in the Central Bank Staff Cooperative Limited in which Nalin Bilochan was Incharge of the office and Yuvraj Kumar was the Branch Manager of Biharsharif Branch. The informant deposited the amount in the aforesaid Bank and when he went to withdraw the amount, the Manager said that the money would be withdrawn
Patna High Court Cr.Misc. No.40020 of 2017 (2) dt.31-08-2017 2/3 only after 15.3.2017 and, thereafter, the bank was found closed. The petitioner is said to be brother of Nalin Bilochan. Learned Sessions Judge has mentioned in the impugned order that petitioner was also in-charge of the office of the said Cooperative Bank.
From the written report it appears that there is no allegation of any specific overt act against the petitioner. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Laheri P.S. Case No. 118 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biharsharif, Nalanda, subject to the conditions as laid down under Section 438 (2) Cr. P.C. with further conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioner and (3) if petitioner tampers with
