JUSTICE RAKESH KUMAR ORAL ORDER 26-02-2016 Heard Sri Arun Kumar Singh, learned counsel for the petitioner and Sri A.K.Ojha, learned counsel for the Respondent/South Bihar Power Distribution Co. Ltd. The petitioner, invoking writ jurisdiction of this Court under Article 226 of the Constitution of India, has mainly prayed for quashing of disconnection notice dated 11.12.2014 contained in letter no.2357 issued by the Respondent no.9. It is admitted fact that regarding the dispute, which has been raised in the present

Patna High Court CWJC No.22054 of 2014 (4) dt.26-02-2016 2/2 writ petition, the petitioner has filed an application before the Consumer Grievance Redressal Forum and a case has been instituted vide Case no.44/2013 and the same is still pending. It was jointly submitted that this writ petition may be disposed of with observation that the Consumer Grievance Redressal Forum may take appropriate decision in Case no.44/2013 at the earliest.

In view of facts and circumstances, the Court proposes to dispose of the present writ petition with observation that the learned Consumer Grievance Redressal Forum may take appropriate steps, so that case no.44/2013 may finally be disposed of within three months from the date of receipt/production of a copy of this order.

It goes without saying that the petitioner as well as official of the Respondent/South Bihar Power Distribution Co. Ltd. shall render full co-operation in disposal of the case within time as indicated herein above. Till the matter is finally decided by the Forum, the disconnection notice shall be kept in abeyance subject to payment of regular energy bill by the petitioner. The writ petition stands disposed of.
