Patna High Court CR. MISC. No.57363 of 2019(2) dt.11-09-2019 2/3 registered for the offences punishable under Sections 147, 148, 149, 188, 341, 342, 323, 325, 332, 333, 337, 338, 353, 427, 449, 450, 451, 452, 461 and 120(b) of the Indian Penal Code and 3/ 4 of Damage to Public Property Act.
Allegation against 167 persons including the petitioners is that they were indulged in rioting and creating disturbance in the Police Lines. Petitioners happen to be the trainee constables.
Submission of the learned counsel for the petitioners is that there is no specific allegation have been attributed against any of the petitioners and other accused persons have been granted anticipatory bail by different co-ordinate Bench of this Court vide order dated 01.07.2019 passed in Criminal Miscellaneous No. 40237 of 2019 and vide order dated 19.7.2019 passed in Criminal Miscellaneous No. 44514 of 2019. Heard learned A.P.P. also.
In view of the above facts and circumstances, let petitioners, above named in the event of their arrest or surrender before the Court below within two weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned Sub- Judge XVI-Cum-ACJM, Patna,
Patna High Court CR. MISC. No.57363 of 2019(2) dt.11-09-2019 3/3 in connection with Buddha Colony P.S. Case No. 435 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned and they will co-operate in the investigation as well as authorities concern in any proceedings initiated against them, otherwise prosecution shall be at liberty to move for cancellation of their bail bonds.
