JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-07-2015 Heard learned counsel for the petitioners and the State.
The petitioners apprehend their arrest in a case for the offences under Section 396 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.
It appears from the order of learned Sessions Judge that the petitioners' name figured in course of investigation and the petitioners are still absconding.
In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners. However, if the petitioners surrender before the court below (Sub-Divisional Judicial Magistrate, Sherghati, Gaya) within four weeks from today and pray for regular bail, the same would be disposed of
Patna High Court Cr.Misc. No.51944 of 2014 (5) dt.03-07-2015 2 / 2 preferably on the same day on its own merit without being prejudiced to the order of this Court.
