JUSTICE SATYAVRAT VERMA ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498(A), 379, 494, 504 and 506/34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that petitioner is the husband and in pursuance of the order of this Court the matter was referred for mediation where the dispute was amicably resolved and the informant willingly accompanied the petitioner to her matrimonial home where she is staying with the petitioner happily. It is further submitted that even the learned Mediator by way of abandoned precaution had called the informant twice for ascertaining as to whether the petitioner is keeping her well or not on which the

Learned counsel for the informant does not dispute the submission made by the learned counsel for the petitioner but then submits that today he has received instruction that the petitioner is not maintaining her well.
Learned counsel for the petitioner rebuts the submission of the learned counsel for the informant and submits that once the issue was amicably resolved and the informant till date is staying with the petitioner and what has been submitted by the learned counsel for the informant appears to be a normal wear and tear off. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jehanabad Mahila P.S. Case No. 38 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
