JUSTICE BIRENDRA KUMAR ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody in connection with Purnea Sadar (Mufassil) P.S. Case No. 123 of 2016 for the offence punishable under Section 304B/34 of the Indian Penal Code.

Petitioner is husband of the victim, who died in unnatural circumstances within two and half years of her marriage in her matrimonial house. There is allegation of demand of more dowry and torture for the same soon before the death of the victim. Submission of the petitioner is that petitioner is in custody since 04.05.2016 and for trivial dispute the victim committed suicide.

Patna High Court Cr.Misc. No.51830 of 2016 (5) dt.30-01-2017 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail for the present. The bail prayer of the petitioner is refused. However, the petitioner may renew the prayer for bail after nine months from the date of receipt of a copy of this order.
