JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Mashrakh P.S. Case No.251 of 2015, disclosing offences under Sections 414, 467 and 468 of the Indian Penal Code.

It is alleged that a stolen motorcycle was found parked in front of petitioner's house. The

No.46667 of 2015 (2) dt.16-10-2015 2/3 petitioner is said to have shown papers in support of the genuineness of the motorcycle upon scrutiny of which, the police found that engine number, as mentioned in the owner book, did not match with the engine number of the said motorcycle.

Learned counsel, appearing on behalf of the petitioner, has submitted that petitioner has no concern with the said motorcycle. He had not produced before the police any document in support of the said motorcycle. In support of his submission, he has referred to the seizure list, which does not indicate seizure of the document, said to have been shown by the petitioner to the police. He has further submitted that petitioner is in custody since 20.08.2015 and has got no criminal antecedent.

In view of the nature of accusation, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra, in connection with Mashrakh P.S. Case No.251 of 2015. This is subject to the condition that the petitioner shall present himself before the police/Court,

Patna High Court Cr.Misc. No.46667 of 2015 (2) dt.16-10-2015 3/3 as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
