JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-04-2019 The learned counsel for the parties are in agreement that the present case is squarely covered by a judgment of the Apex Court in the case of Mukesh & Anr. Vs. The State of Bihar & Ors., reported in (2017) 5 SCC 383, hence the writ application can be disposed off with liberty to the petitioner to file representation before the respondent authorities. Having regard to the submissions made by the learned counsel for the parties, the present writ application is disposed off with liberty to the petitioner to file representation before the respondent no. 4 enclosing a copy of this order and the judgment of the Apex Court in the case of Mukesh & Anr.

Patna High Court CWJC No.15862 of 2018(2) dt.08-04-2019 2/2 (Supra), and the respondent no. 4 is obliged to examine the case of the petitioner and take final decision in light of the judgment of the Apex Court in the case of Mukesh & Anr. (supra) within a maximum period of three months from the date of receipt/production of a copy of this order along with the representation.
