The petitioner apprehends his arrest in connection with Fatuha P.S. Case No. 133 of 2016 registered under Sections 504, 505, 506 of the Indian Penal Code and 3⁄4 of the D.P. Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. On perusal or Annexure 2, it appears that petitioner has returned money in the account of father of the informant through RTGS. Further submission is that it would appear from Annexure no. 5 that co-accused persons namely, Sohan Thakur, Ajay Thakur and Munna Thakur have already been allowed bail by different Benches of this Court vide Cr. Misc. Nos. 26606 of

Patna High Court Cr.Misc. No.35428 of 2017 (3) dt.23-08-2017 2/2 2017 and 32531 of 2017.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., Patna City, Patna in connection with Fatuha P.S. Case No. 133 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
