JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 The petitioner being husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and Sections 4 of the Dowry Prohibition Act.
On the joint prayer of the parties, the matter was referred to the Mediation & Conciliation Centre of the State Legal Services Authority vide order dated 23.09.2015. The report of the mediator at Flag-P dated 26.11.2015 reflects that the issue could not be reconciled through the process of mediation.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.45213 of 2015 (4) dt.04-02-2016 2/2 petitioner that now the issue has been resolved between the parties and the complainant has filed a compromise petition before learned Court below. The certified copy of the same has been produced. Let it be kept on record.
The petitioner and the complainant are present in the Court. Learned counsel for the complainant accepts the factum of compromise.
In the circumstance, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Buxar in connection with Complaint Case No. 1301(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
