2. The petitioner seeks bail in Motihari Town P.S. Case No. 33 of 2024 registered for the offence punishable under Sections-461/379 of the Indian Penal Code.

3. Allegedly, in the night of 11-01-2024, some unknown burglars committed theft of gold and silver in the jewellery shop of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted on behalf of the petitioner that there is no independent witness. Both the

The petitioner is not named in the FIR and his name has figured during investigation in confessional statement. Nothing was recovered from conscious possession of the petitioner. The petitioner is in custody since 22-03-2024. The co-accused persons having similar allegation have been granted bail by this court vide orders dated 20-082024 & 22-08-2024 passed in Cr. Misc. Nos. 55009 of 2024 and 55086 of 2024 respectively.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Town P.S. Case No. 33 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
