JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 323, 308 and some other allied Sections of the Indian Penal Code.

As per the prosecution case, on a petty dispute scuffle took place in which this petitioner assaulted the daughter of informant with Lathi causing injuries on her head. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No case u/s 308 of the IPC is made out against this petitioner. Petitioner claims clean antecedent and is in custody since 26.07.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
