JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-08-2025 The present petition has been filed for restoration of a contempt petition bearing MJC No.1978 of 2019, which has stood dismissed for non-prosecution, vide order dated 10.01.2025.

The learned counsel for the petitioner submits that on account of non-filing of vakalatnama by the present counsel, his name did not appear in the daily-cause, hence the list could not be marked leading to his non-appearance when the said case was called out of hearing. Nonetheless, it is submitted that he shall be filing vakalatnama, within a period of two weeks from today in the aforesaid contempt petition.

Having regard to the facts and circumstances of the case

Patna High Court MJC No.2801 of 2025(2) dt.22-08-2025 2/2 and taking into consideration the averments made in the present petition, though I deem it fit and proper to direct for restoration of the aforesaid contempt petition bearing MJC No.1978 of 2019 to its original file, however subject to the present counsel filing vakalatnama on behalf of the petitioner in the aforesaid contempt petition, within a period of two weeks from today.

4. The present restoration petition stands disposed off on the aforesaid terms.
