The petitioners apprehend their arrest in a case registered for the offence under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Total 1755 liters of Nepali country made wine has been recovered from the pickup van.

It is submitted on behalf of petitioners that petitioners have clean antecedent and they have falsely been implicated in the present case. He further submits that the name of the petitioners have transpired on the basis of confessional statement of co-accused and nothing has been recovered from

He further submits that petitioners have no concern with the seized articles or the vehicle in question and petitioners are neither the driver nor the owner of the said vehicle in question.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani in connection with Kaluahi P.S. Case No. 143 of 2021 corresponding to G.R. No. 1691 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
