By means of this writ petition, the petitioner has prayed for a direction to the respondent No. 6 / The District Programme Officer (Establishment), Samastipur to grant the petitioner BA (Trained) pay scale as well as pay scale of the headmaster notionally from due date with all consequential benefits.

3. The respondent Nos. 5 and 6 have filed a counter affidavit, wherein, in paragraph No. 10 it has been stated as under:

"10. That it is proper place to mention

Patna High Court CWJC No.13917 of 2023(6) dt.27-08-2025 2/3 here that in the meeting of Primary School Teacher Promotion committee dated 07.11.2023, it has been decided vide proposal No. 5 to grant the promotion to such type of teachers. As per the departmental instruction process of promotion has already started in which name of the petitioner is also under consideration"

4. On perusal of paragraph No. 10 of the counter affidavit filed by the respondent Nos. 5 and 6 which has been quoted, hereinabove, it appears that the petitioner's case for promotion is under consideration.

5. The counter affidavit by the respondent Nos. 5 and 6 was filed on 12.02.2024 stating that the petitioner's case for promotion is under consideration. The learned counsel for the parties have no instructions regarding the current status of the petitioner's promotion, as prayed for in the writ petition.

6. Under the circumstances, in view of the statement made in paragraph No. 10 of the counter affidavit filed by the respondent Nos. 5 and 6 that the case of the petitioner for promotion is under consideration, this writ petition is hereby disposed off with a direction to the respondents, more particularly, respondent Nos. 5 and 6 to take a final decision in the matter of petitioner's promotion in terms of paragraph No.

Patna High Court CWJC No.13917 of 2023(6) dt.27-08-2025 3/3 10 of the counter affidavit filed by the respondent Nos. 5 and 6 within a period of one month from the date of receipt of a certified copy of this order, if such decision is not already taken.

7. The writ petition is disposed off with the above directions.
