NILU AGRAWAL ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners Mr. Ram Chandra Paswan and learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Bhagwanpur P. S. Case No. 122/2015 registered for the offences punishable under Sections 341, 323, 307, 353, 354, 332, 186/34 of the I.P.C.

The prosecution case is that on 05.06.2015 at 10.00 A.M. informant Anjana Kumari was present in the meeting of Anganbari regarding appointment at Bishanpur. After completion of meeting, Pramukh Lal Babu Paswan and his brother proceeded with informant. After some distance from meeting place, in the way, they assaulted the informant and showed ill behavior after calling five to ten persons, as a result of which informant sustained injury. They also snatched Government papers. Due to

Patna High Court Cr.Misc. No.45701 of 2015 (2) dt.14-10-2015 2/2 intervention of villagers, she could be saved otherwise she would be killed by Pramkukh, Lal Babu Paswan.

It has been submitted by the learned counsel for the petitioners that the allegation is against another co-accused Lal Babu Paswan, who has also lodged Bhagwanpur P.S. Case No. 121/2015 against the informant , who is the C.D.P.O. of the said Block.

It has further been submitted that the petitioners have clean antecedent and there was some altercation between the other co-accused Lal Babu Paswan for which the other co-accused had also lodged the said Bhagwanpur P.S.Case No. 121/2015 and the present case is merely a counter case.

Be that as it may, in case of arrest or surrender within a period of six weeks from today before the Court below, the above named petitioners will be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Begusarai in connection with Bhagwanpur P.S.Case No. 122/2015, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
