The petitioner apprehends his arrest in a case registered for the offence under Section 379, 411 of the Indian Penal Code, 1860 and section 11 of the Mines and Minerals (Development and Regulation) Act, 1957 and Rule 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019.

As per the prosecution case, the Poclain machine of the petitioner extracted sand and kept it on the land of somebody else.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. There is no evidence to support the allegation that the poclain machine or

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Danapur, Patna in connection with Paliganj P.S. Case No. 253/2021, subject to condition as laid down under section 438(2) of the code of criminal procedure.
