JUSTICE SUDHIR SINGH ORAL ORDER 07-05-2015 The petitioners are apprehending their arrest in connection with Runni Saidpur P.S.Case No. 485/2013 instituted under Sections 406, 420, 120(B), 467, 468, 471, 302 and 201 of the Indian Penal Code, pending in the Court of learned C.J.M., Sitamarhi.
Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that Ngeshwar Sahani got executed one sale deed with regard to 3 decimals of land in favour of his wife from his mother. The informant enquired from his mother, who told that she has not executed any sale deed. She
Patna High Court Cr.Misc. No.201 of 2015 (3) dt.07-05-2015 2/3 told the informant that the petitioners had taken her for sanction of old age pension and got her thumb impression on different papers. The mother agreed that she would tell the truth to every body and it was agreed in Panchayati that accused Urmila Devi would execute a deed of relinquishment in favour of the mother of the informant on 6.11.2013. On 5.11.2013 accused persons killed the mother of the informant by pressing her neck. It has been submitted on behalf of the petitioners that complainant is the own bother of petitioner no.1 and as per FIR the death of the mother of the petitioner took place on 5.11.2013.The complainant filed complaint case on 20.11.2013. The complainant has given no explanation regarding the death of the mother. Further it has been submitted that the mother used to reside with the petitioner no.1 and out of love affairs she had given a piece of land to the petitioners. On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned
