The petitioner is apprehending his arrest in connection with Kalyanpur P.S.Case No.57 of 2016, registered for offences punishable under Sections Complaint Case No.27 of 2015 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of running a Company in the name of Bajrang Swyam Sahayata Samuh and they were collecting money in the guise of depositing the same on various plea from the local villagers including the petitioner.
Allegation against this petitioner is that petitioner has taken Rs.12,000/- from the informant and now he is not returning the same.
Submission of the learned counsel for the petitioner is
Patna High Court Cr.Misc. No.36410 of 2017 (2) dt.10-08-2017 2/2 that there is no other allegation against the petitioner and he is ready to pay back the money within a reasonable period if the time is granted to him.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of eight weeks with bank draft of Rs.12,000/- (Rupees Twelve Thousand) in the name of the informant and once the amount is deposited, the learned court below will release the petitioner on bail bond of Rs.25,000/- (Twenty Five Thousand) in connection with Kalyanpur P.S.Case No.57 of 2016 dated 7.5.2016 to the satisfaction of C.J.M., Samastipur and the amount so deposited shall be released in favour of the informant provisionally subject to result of this case. In the meantime, for eight weeks, no coercive steps shall be taken against the petitioner.
With the aforesaid observation, this application is disposed of.
