The petitioner seeks bail in connection with Excise Complaint Case No. 91 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.08.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that the allegation is of recovery of 433.5 litres of liquor from a Tata pickup van.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 29.08.2021, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka in connection with Excise Complaint Case No. 91 of 2021.
