Petitioner is in custody since 05.07.2016 in connection with Chand P.S. Case No. 86 of 2016 registered under Sections 304(B)/34 of the Indian Penal Code.

Accusation is of murder on account of non-fulfillment of dowry demand.

Learned counsel for the petitioner has submitted that the petitioner happens to be the husband of the deceased has falsely been implicated in this case. In fact, the daughter of the informant herself committed suicide, which would be evident from written report. The petitioner has never assaulted or tortured the deceased for the alleged demand of dowry. Petitioner is rotting in custody for the last five months.

Patna High Court Cr.Misc. No.51511 of 2016 (4) dt.13-02-2017 Learned A.P.P. on the other hand opposed the prayer for bail.

Considering the nature of accusation, this Court is not inclined to grant regular bail to this petitioner. Accordingly, the prayer for bail of this petitioner is rejected. However, the petitioner is at liberty to renew his prayer for bail after framing of charge. (Arvind Srivastava, J) brajesh/- U T
