The petitioner seeks bail in Ganga Bridge P.S. Case No. 155 of 2019, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

33 litres of foreign liquor has been recovered from a tempo and driver of the said tempo disclosed that the said liquor belongs to petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the seized liquor. Petitioner is in custody since 07.09.2021. Investigation is complete.

Patna High Court CR. MISC. No.70014 of 2021(2) dt.22-12-2021 2/2 Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent and ten cases of similar nature are pending against him. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Excise Court, Vaishali at Hajipur in connection with Ganga Bridge P.S.
