JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-b)A, 26 and 35 of the Arms Act and 53(b) of the Bihar Excise Amendment Act.

Allegation is that petitioner was apprehended by police while he was trying to flee away and from his possession two live cartridges were recovered.

It has been submitted on behalf of petitioner that he is in custody since 9.7.2016. He has got no criminal antecedent. Chargesheet has been submitted against him. No allegation of tampering of witnesses is alleged against him. Two live cartridges are said to have been recovered from possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.51550 of 2016 (2) dt.06-12-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Imamganj P.S. Case no. 109 of 2016.
