Patna High Court CWJC No.16907 of 2018(2) dt.04-12-2018 2/2 been taken in the present writ petition and till passing of the final order the petitioner seeks protection.
Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file objection under Section 9 of the Bihar & Orissa Public Demands Recovery Act, 1914 within a period of four weeks from today and in case such an objection is filed, the Certificate Officer, Khagaria shall pass the final order under Section 10 of the Bihar & Orissa Public Demands Recovery Act, 1914 in connection with Certificate Case No. 3 of 2017-18 after considering the said objection to be filed by the petitioner.
Till passing of the final order, no coercive steps shall be taken against the petitioner.
However, it is made clear that in case the objection is not filed within a period of four weeks from today, the Certificate Officer shall proceed ex parte.
